Terms & Conditions

These Terms & Conditions (“Terms”) apply to prophecyesports.com and all Prophecy Esports websites, stores, community features, and services that reference or link to these Terms (the “Services”), owned and operated by Prophecy Esports (“Prophecy”, “we”, “us”, “our”) of New South Wales, Australia. By accessing or using any part of the Services — including creating an account, joining a team, entering a tournament, posting in forums, or purchasing products or memberships — you agree to be bound by these Terms and by our Privacy Policy and any posted community and competition rules. If you do not agree, do not use the Services.

1. Eligibility & Accounts

You must be at least 13 years old to use the Services. If you are under the age of majority where you live, you may only use the Services with the consent of a parent or guardian, who agrees to these Terms on your behalf. You are responsible for the accuracy of your account information, for keeping your login credentials secure, and for all activity under your account. Notify us immediately of any unauthorised use. One person per account; accounts may not be sold, transferred, or shared. We may refuse, reclaim, or require a change to any username at our discretion (for example, impersonation or offensive names).

2. Acceptable Use & Community Conduct

You agree not to, and not to attempt to:

  • Break any applicable law, or use the Services for any unlawful, harmful, or fraudulent purpose;
  • Harass, abuse, threaten, defame, or discriminate against any person, or post content that is hateful, obscene, sexually explicit, violent, or otherwise objectionable;
  • Cheat, exploit bugs, use unauthorised software, or otherwise gain unfair advantage in any competition run on or through the Services;
  • Impersonate any person, team, or Prophecy staff, or misrepresent an affiliation;
  • Spam, scrape, data-mine, or use bots or automated access without our written permission;
  • Upload malicious code, interfere with the operation or security of the Services, or access areas or data you are not authorised to access;
  • Post other people’s personal information without their consent.

We may moderate, remove, or restrict content and accounts at our discretion to keep the community safe, including muting, suspending, or banning accounts and removing content that breaches these Terms or our posted rules. Moderation actions may be logged.

3. Your Content

You retain ownership of the content you post to the Services (profiles, posts, images, emojis, team branding, and similar) (“User Content”). By posting User Content you grant Prophecy a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt (for example, resizing images), publish, and display that content for the purposes of operating, promoting, and improving the Services. You are solely responsible for your User Content and represent that you have all rights necessary to post it and that it does not infringe any third party’s rights. Content posted in public areas is visible to others — see our Privacy Policy. We may remove User Content at any time. If you believe content on the Services infringes your copyright, contact us with details and we will review it promptly.

4. Tournaments, Scrims & Community-Hosted Events

Competitions run on the Services are subject to these Terms, the posted competition rules, and any event-specific rules. Match results, brackets, seeding, and eligibility decisions may be made by tournament administrators, whose reasonable decisions are final. We may disqualify entrants or void results for cheating, misconduct, or breach of rules.

Community-hosted tournaments are created and run by members, not by Prophecy. The host is solely responsible for their event, including its rules, administration, and any prize they choose to offer. Prophecy does not guarantee, administer, or take responsibility for prizes offered by community hosts, and is not a party to any arrangement between hosts and entrants. We may moderate, edit, or remove any community-hosted event at our discretion. Prizes offered by Prophecy directly will be described in the relevant event’s rules, are not transferable, and where a prize is unavailable we may substitute one of equal or greater value. Competitions are void where prohibited by law; entrants are responsible for their own tax obligations and for complying with the laws of their jurisdiction.

5. XP, Cosmetics & Virtual Items

The Services include virtual features such as XP, levels, achievements, cosmetics, name styles, badges, and similar unlockables (“Virtual Items”). Virtual Items have no monetary value, are not redeemable for money, cannot be transferred or sold, and are licensed — not sold — to you for use within the Services only. We may modify, rebalance, grant, or revoke Virtual Items at any time, including where they were obtained through error, exploit, or breach of these Terms, and Virtual Items may be lost if your account is terminated. Nothing in this section limits your rights under the Australian Consumer Law in respect of anything you have paid for.

6. Store, Products & Memberships

Products and memberships offered through our store are subject to availability, and prices, product descriptions, and membership benefits may change at any time (changes do not affect orders already placed). We reserve the right to refuse or cancel any order — including where a product was mispriced or suspected of fraud — in which case we will refund any amount paid for that order. Colours and images are displayed as accurately as reasonably possible but may vary by screen. You agree to provide current and accurate purchase and account information. Payments are processed by third-party payment providers; delivery times are estimates. Any recurring membership will renew automatically until cancelled, and you can cancel at any time to stop future renewals. Refunds and returns are handled in accordance with any posted returns policy and always subject to the Australian Consumer Law (see below).

7. Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (“ACL”). For major failures with a service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the ACL or any other law that cannot lawfully be excluded.

8. Intellectual Property

The Services — including the Prophecy name, logos, branding, site design, software, and all content we create — are owned by or licensed to Prophecy and are protected by intellectual property laws. Except as permitted by law or these Terms, you may not reproduce, distribute, modify, sell, or exploit any part of the Services without our prior written permission. All third-party trademarks (including game titles and platform names) belong to their respective owners; their use on the Services does not imply any affiliation with or endorsement by them.

9. Third-Party Services & Links

The Services link to and integrate with third-party services (including Discord, Twitch, YouTube, and payment providers). We do not control and are not responsible for third-party services, their content, or their terms and privacy practices, and linking does not imply endorsement. Your use of a third-party service is at your own risk and subject to its own terms.

10. Disclaimers

Subject to Section 7 (Australian Consumer Law), the Services are provided on an “as is” and “as available” basis. We do not warrant that the Services will be uninterrupted, timely, secure, or error-free, that defects will be corrected, or that content (including user-generated content, statistics, and results) is accurate or complete. Information on the Services is provided for general information only and you rely on it at your own risk.

11. Limitation of Liability

To the maximum extent permitted by law, and subject always to Section 7 (Australian Consumer Law): (a) Prophecy and its officers, employees, contractors, and partners will not be liable for any indirect, incidental, special, or consequential loss or damage, loss of profits, revenue, data, or goodwill arising out of or in connection with your use of (or inability to use) the Services; and (b) our total aggregate liability for all claims relating to the Services is limited to the greater of the amount you paid us in the 12 months before the event giving rise to the claim and AUD $100. Where liability for breach of a non-excludable guarantee can be limited, our liability is limited (at our option) to re-supplying the relevant goods or services, or paying the cost of re-supply.

12. Indemnity

You agree to indemnify Prophecy against claims, liabilities, damages, and reasonable costs (including legal costs) made by any third party arising out of your breach of these Terms, your User Content, or your violation of any law or third-party right — except to the extent caused by our own negligence or breach.

13. Suspension & Termination

You may stop using the Services and request account deletion at any time. We may suspend or terminate your access to all or part of the Services, without prior notice, if you breach these Terms or our posted rules, if required by law, or where necessary to protect the Services or their users. On termination, your licence to use the Services ends; sections of these Terms that by their nature should survive (including Sections 3, 7, 8, 10, 11, 12, and 15) survive termination.

14. Changes to the Services or Terms

We are always developing the Services and may add, change, or discontinue features at any time. We may update these Terms from time to time; the current version will always be posted on this page with the date at the top, and material changes will be notified by reasonable means (such as a site notice). Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Services.

15. Governing Law

These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia. If you use the Services from outside Australia, you are responsible for compliance with your local laws, and nothing in this section deprives you of the protection of mandatory consumer laws of your country of residence.

16. General

These Terms, together with the Privacy Policy and any posted rules or policies, are the entire agreement between you and Prophecy regarding the Services. If any provision is found invalid or unenforceable, it will be severed and the remainder will continue in full force. Our failure to enforce any right is not a waiver of it. You may not assign these Terms; we may assign them as part of a business sale or reorganisation. Headings are for convenience only.
